ARTICLE.1. ACCEPTANCE OF THE GENERAL CONDITIONS OF USEThe User is presumed to know and accept, without reserve, all of the GCU solely because of his connection to the Site and Applications and his use of the Services, regardless of the digital reception terminals used.

The GTCU apply concurrently to the General Conditions of Sale https://www.magicentertainmentlondon.co.uk

The User is invited not to connect to the Site and the Applications, nor to use the Services if he does not accept all or part of the documents referred to above.

Magic Entertainment London may change the terms of the TOU at any time. The User is expressly informed that the version in force is the one that is posted on the Site and the Applications, on the date of his access to any of the Services, which the User recognizes and accepts without restriction, committing to refer to it systematically during each connection.

ARTICLE.2. REGISTRATION FOR SERVICES AND MANAGEMENT OF IDENTIFIERS

Magic Entertainment London makes available through the website https://www.tickettailor.com different Services accessible for the payment and purchase of tickets through the internet . The User is informed that Magic Entertainment London reserves the right to modify or delete, at any time, without notice and at its sole discretion, all or part of the Services.

2.1 How to register for the Services

the User must complete a registration form by providing personal information, such as name, first name, email address, password, which will then identify him and facilitate access to the Services.

The User undertakes to provide true, accurate and complete information on this form. The User undertakes to update this information with each change of situation.

 

2.2 Management of identifiers

The email address and password (hereinafter the « Identifiers ») allow each User to identify himself and to connect to the Services. 

Each User is entirely responsible for the use of his Identifiers which he undertakes to keep secret and not to disclose in any form whatsoever to third parties. 

Each User is therefore solely responsible for the use of the Service(s) made under his identification. Any connection or transmission of data made using the Identifiers will be deemed to have been made by the User and under his exclusive responsibility. Consequently, Magic Entertainment London cannot be held responsible for the fraudulent use of User Identifiers by a third party. 

ARTICLE.3. ACCESS TO AND SUSPENSION OF SERVICES

3.1 Availability of the Site and Applications

Magic Entertainment London is committed to making its best efforts to ensure that access to and operation of the Sites and Applications is provided 24 hours a day, 7 days a week without interruption. However, Magic Entertainment London cannot be held liable for the temporary unavailability of the Sites, Applications and Services:

(i) in the event of maintenance of the Sites, Applications or servers on which they are hosted, 

(ii) in the event of events outside its control and control 

(iii) due to force majeure. Magic Entertainment London will inform the User beforehand of the unavailability if the event causing the unavailability is foreseeable. 

3.2 Suspension of Access

Magic Entertainment London reserves the right to suspend access to the Services:

(i) in the event of loss, theft and/or use of the User’s Identifiers that the User has informed him of, 

(ii) use that does not comply with the provisions of this Agreement, 

(iii) in the case of maintenance operations. Magic Entertainment London cannot be held liable for these interruptions and the consequences that may result for the User

ARTICLE.4. USER ENGAGEMENT

The User is informed that all laws and regulations in force are applicable on the Internet. 

4.1 General behaviour of Users

Upon registration and any use of the various Services, any User agrees with Magic Entertainment London and other Registered Users and generally with any third party, to: 

Provide accurate, up-to-date, true, complete data;

Do not provide incorrect, outdated data;

Not to usurp, in whole or in part, the identity, title or quality of a third party;

Respect the management of access and in particular do not hide its true identity by logging in under the personal settings of another User;

 

In the event of non-compliance with the principles set out above, Magic Entertainment London reserves the right to suspend or refuse access, without notice or compensation, temporarily or permanently, to all or part of the Services. 

Any User who registers and uses the various Services, including in particular the publication of personal data concerning him, acknowledges that he proceeds under his full and exclusive responsibility, including responsibility for the dissemination and reproduction of information, and the consequences thereof for other Users and/or interested third parties. 

Finally, it is strictly forbidden, under penalty of criminal and/or civil sanctions, to extract a qualitatively or quantitatively substantial part of the database consisting of data disseminated via the public parts of the various Services. 

4.2 Commitments regarding Contributions published by the User 

The Site, the Applications and the information published therein are reserved: 

(i) the consultation of information using the automated data processing system of Magic Entertainment London (ii) strictly reserved for the private and non-commercial use of the User and not intended for collective use, free or paid. 

The User declares and acknowledges that all information, data, texts, software, music, sounds, photographs, images, videos, messages or any other content that he issues (hereinafter referred to as the «Contribution») are under his sole responsibility. 

The User undertakes with regard to Magic Entertainment London, as well as other Users and generally any third party, to unconditionally comply with all applicable legislation, and more specifically: 

Intellectual property and industrial property rights applicable to multimedia creations, software, texts, databases, articles, photos, videos, trademarks, databases, images of any kind;

Image rights of models on photographs;

The right of photographers and agencies to these photographs;

The French Data Protection Act, Fichiers et Libertés, concerning the protection of individuals with regard to the processing of personal data;

The law of the press;

The legal framework for protecting computer fraud.

Accordingly, any Registered User is prohibited from both Magic Entertainment London, other Registered Users and generally from any third party:

To broadcast defamatory, abusive, harassing or threatening remarks, or in violation of the rights of others;

Promote crimes against humanity, incite racial hatred or pedophilia;

Create a false identity or impersonate a third party;

Transmit viruses, a Trojan horse, logic bombs or any other harmful or destructive program;

To take back all or part of the content of pre-existing works without the authorization of the rights holders on those works;

To reproduce and/or use the brand, corporate name, logo or any distinctive sign and generally any data of any kind, editorial, graphic or other of the Publisher or a third party;

To carry out or even attempt an intrusion within the Sites and/or Applications or the administrative information system of the Sites and/or Applications or to modify, in whole or in part, the elements contained therein;

Not to exploit the Services or personal data to which he could have had access for commercial purposes;

Not offer products or services from the Sites and Applications that enable it to obtain remuneration directly or indirectly;

Do not limit access to or use of the Sites and Applications;

Do not modify any mentions or elements of the Sites or Applications;

The User agrees to indemnify Magic Entertainment London for any damage directly or indirectly related to the breach of these guarantees.

Any User who acts in fraud of these GCU is exposed to civil and/ or criminal proceedings.

4.3 Duty of Vigilance – Means Used to Combat Illicit Activities

Any User acknowledges to be informed that a posteriori moderation on the Services is implemented to control, delete or modify the contents published by the Users which would appear contrary to the laws and regulations in force, or which have been reported as such by the judicial authority.

Any User acknowledges to be informed that an alert system is made available at any time to any person who wishes to report the publication on the Services of any message of a contentious nature of which he would be aware in particular those that fall under the offences under Article 24 paragraphs 5 and 8 of the Press Act and Article 227-23 of the Penal Code such as the apology of crimes against humanity, incitement to racial hatred, child pornography, and this in accordance with the provisions provided for in Article 6-I-7 paragraphs 3 and 4 of the Law for Confidence in the Digital Economy of 21 June 2004. 

To exercise this right, the User must send an email to “[email protected] » taking care to identify the contentious message and to signal that we can identify the contentious message, and to explain why it is contrary to applicable laws and regulations, and then providing, for individuals, their surname, first name, domicile and telephone number, and for legal persons, their name, company name, address, telephone number and the identity of their legal representative.

It is understood, that the fact of abusing this faculty is likely to engage the responsibility of the one who exercises it.

ARTICLE.5. RESPONSIBILITY OF MAGIC ENTERTAINMENT LONDON

The User acknowledges and accepts that the content of shows and events, published on the Sites and Applications, is provided by the organizers of shows and events. Magic Entertainment London is therefore not responsible for:

-the form, nature and content of these sheets, and in particular their compliance with the applicable regulations in force;

-the inaccuracy of the information provided by the organisers and the lack of validity of the information provided.

In accordance with the provisions of the Confidence in the Digital Economy Act of 21 June 2004, Magic Entertainment London’s liability for the Services, enabling Users to make Contributions is that of a content host and is not part of the editorial activity of Magic Entertainment London which merely makes the Services available to Users and stores the content on its own Sites and its Applications.

ARTICLE.6. PERSONAL DATA AND COOKIES

Magic Entertainment London undertakes not to use the User’s data.

ARTICLE.7. HYPERLINKS AND PARTNER BUSINESS SITES

Setting up a hyper link to the Site requires prior approval from Magic Entertainment London. Magic Entertainment London is not responsible for such links.

Magic Entertainment London may also provide links to other websites or other sources of information managed by third party sites. Magic Entertainment London is unable to control the content of these sites, the existence of such links shall not engage the responsibility of Magic Entertainment London for the content, advertisements, products or services available on these external sites, what the User acknowledges and accepts. In particular, the liability of Magic Entertainment London for direct or indirect damages such as loss of customers, legal action, commercial disorder of any kind, loss of brand image, loss of profit, may not be sought either for the quality and/ or specifications of products and services sold by business partners, or for payment transactions made on these sites.

ARTICLE.8. INTELLECTUAL PROPERTY

8.1 Content of the Services and Shows

The content of the Sites and Applications and the use of the Services, protected by law and in particular the provisions of the Intellectual Property Code, are exclusively intended for the information and personal use of the User who benefits from a private use, non-collective and non-exclusive. 

Unless expressly authorized in advance by Magic Entertainment London, any reproduction, representation and use other than those referred to above and in particular:

(i) any adaptation, making available to the public at its request or not, distribution, rebroadcasting in any form whatsoever, networking, public communication of all or part of the works, services, trademarks and all elements protected or likely to be protected by intellectual property rights reproduced on the Sites and Applications;

(ii) any extraction or reuse, including for private purposes, of a substantial part of the content of the databases created by the Sites and Applications;

(iii) any repeated and systematic extraction or reuse, including for private purposes, of even a non-substantial part of the content of the databases created by the Sites and Applications;

(iv) any link, access, modification, addition, deletion that relates to the automated processing system of the online edition and modifies the conditions of publication or the editorial policy.

 8.2 Contributions of the Users

The User represents and warrants:

– be the owner or holder of the necessary rights and/or authorizations relating to copyright, personality rights or other intellectual and/or industrial property rights possibly attached to his Contribution;

– have the prior written permission of each natural person identifiable in their Contribution to use their name and/or image and/or voice for the purposes of their dissemination on the Services. 

In return for the use of the Services, the User assigns to Magic Entertainment London, free of charge, its rights to its Contributions for the following uses:

(i) reproduction, in whole or in part, of its Contributions, their integration and communication on the Sites and Applications, accompanied or not by other Content and their communication to the public by any communication media known or unknown to date;

(ii) adaptation for the purposes of the rights referred to above.

This assignment is granted free of charge for the entire world and for the duration of the legal protection.

 8.3 Brands

The “Magic Entertainment London” brand and associated logo(s) are protected in the United Kingdom. Unless expressly authorized in advance, any use of these trademarks as well as any other trademarks, figurative or not belonging to Magic Entertainment London or to third parties, exposes the User to criminal and/ or civil proceedings.

ARTICLE.9. RETENTION, ARCHIVING AND AGREEMENT ON EVIDENCE

9.1 Retention and Archiving

In accordance with the provisions of the Confidence in the Digital Economy Act of 21 June 2004, Magic Entertainment London is required to in its capacity as a Producer, to hold and store data capable of enabling the identification of any person who has broadcast content through it, in case the judicial authorities request it.

Computer files kept in the computer systems of Magic Entertainment London under reasonable security conditions, will be considered as proof of deposit of the Contributions as well as the various transmissions of information between the User and Magic Entertainment London allowing the latter to ensure the processing desired by the User.

The archiving of this data is carried out on a reliable and durable medium so as to correspond to a faithful and durable copy, in accordance with article 1348 of the Civil Code.

9.2 Convention on evidence

Magic Entertainment London and the User agree to communicate primarily electronically. These electronic communications are authentic between Magic Entertainment London and 

the User and constitute admissible, valid and enforceable evidence.

ARTICLE.10. APPLICABLE LAW AND COMPETENT JUDGE

Failure by the User, regardless of its location, to comply with any of the provisions of these General Conditions of Use and more generally any difficulty affecting its execution, interpretation or validity, are subject to the law of United Kingdom and the English courts.

ARTICLE 11 . TICKET PRICES

The price of advance reservations on the Magic Entertainment London site through the Ticket Taylor sales site is: 

PREMIUM RATE: £50… NON-REFUNDABLE AND NON-TRANSFERABLE SEATS

SUPER PREMIUM RATE: £100 WITH ONE GLASS OF FRENCH CHAMPAGNE… PLACE NON REFUNDABLE AND NON EXCHANGEABLE

Ticket prices can vary on partner sites from £50 to £100. On the partner sites, booking or sales fees may be requested in addition to the amount of the place for each User.

In case of cancellation of a show in case of Force Majeure, the User’s seats will be refunded by the reseller site on which the Customer purchased his ticket.

Magic Entertainment London reserves the right to change its programming.

ARTICLE. 12. PUBLIC SAFETY 

For the safety of the public of Magic Entertainment London any entry during the show is prohibited. 

Magic Entertainment London is committed to starting its shows on time and not to open the door to the show room once the show begins.

Any unexpected release during the show is final.

Customers must present to the control: a Sanitary Pass in their name in case of request, proof of payment of their places and wear a sanitary mask correctly on the nose and mouth from the age of 6 years to be able to enter the room where the show is played during the periods of virus and contamination decided by the Law. Children and their parents will remain seated throughout the show and will not move into the theater, except in case of request invitation of the Artist to join him on stage.The photos and videos of the shows are prohibited unless prior agreement of Magic Entertainment London. Cell phones must be down.

ARTICLE.13 CUSTOMER DELAY

No entry possible after the start of the show. Magic Entertainment London cannot be held responsible for the various causes of delays due to customers. The Customer must arrive between 15 minutes and 30 minutes before the schedule of the show he has booked. The Customer must have a health mask properly placed on his mouth and nose from the age of 6 years. The customer must present to the control his reservation or his ticket and a Sanitary Pass in his name The places sold are only valid for the show and on the date and the time indicated on the reservation of the customer. As the customer’s seats have been paid, they cannot be resold by the Customer, Magic Entertainment London or the Partner Sites.
